Brazoria County Clerk - Marriage License Office

Brazoria County is a large, fast-growing county south of Houston. The County Clerk's office maintains three locations across the county to serve residents and applicants. All three offices can process marriage license applications. The main office is in Angleton, but there are also locations in Pearland and Lake Jackson. Couples can choose whichever office is most convenient for them.

An online application option is available at the Brazoria County website. This lets you fill out much of the form before your visit, which can reduce time spent at the office. Both applicants must still come in together to finalize the application and receive the license. Confirm which offices accept online pre-applications and whether appointments are required before you visit.

The Brazoria County Clerk accepts multiple payment methods. The standard marriage license fee is approximately $82. Couples who complete the Twogether in Texas premarital course pay a reduced fee. Bring the completion certificate when you apply. The county's online application system may have additional instructions about payment options.

If either applicant was divorced within the last 30 days, a certified copy of the divorce decree is required. Texas Family Code Section 2.009 bars issuing a license within 30 days of a divorce finalization.

The Brazoria County Clerk's website provides information about all three office locations, the online application option, and current fee schedules for marriage licenses.

How to Get a Marriage License in Brazoria County

Brazoria County allows applicants to start the process online. Both people still must go to a clerk's office together. The online form can save time at the counter. Once there, show your IDs, confirm Social Security numbers, and pay the fee. The license is issued the same day.

Each applicant must have the following:

  • Valid government-issued photo ID (driver's license, state ID, passport, or military ID)
  • Social Security number (you must provide it; a card helps)
  • Certified copy of divorce decree if divorced within the last 30 days
  • Court order if either applicant is under 18 (required since September 1, 2017)

Residency is not required. The license works anywhere in Texas. No blood test is needed. The standard state application form under Texas Family Code Section 2.004 collects full legal names, birth dates, birthplaces, Social Security numbers, and prior marriage history. Both applicants sign under oath. If either person has been married before, be ready to state when the prior marriage ended and how it ended.

The 72-Hour Waiting Period and Fees

Texas law requires a 72-hour wait between when the clerk issues the license and when the ceremony can be held. This rule is in Texas Family Code Section 2.204. A license issued Friday morning cannot be used for a ceremony until Monday morning.

Active duty military members are exempt from the wait. A judge can grant a written waiver for cause. Couples who complete the Twogether in Texas premarital education course skip the 72-hour hold and pay a lower fee. That course is 8 hours. Brazoria County's standard fee is about $82. With a Twogether in Texas completion certificate, that amount drops. Check the clerk's website for the exact reduced rate. Present the certificate when you apply in person.

The license is valid for 90 days. If you do not marry in that time, it expires and you must start over. Most couples apply one to two weeks before their ceremony. That gives enough time after the 72-hour wait without getting close to the 90-day limit. Brazoria County sees high application volume, especially before holiday weekends, so visit earlier in the week if possible.

The Brazoria County Clerk also handles informal marriage declarations. Both people must appear. The fee is about $42. The declaration becomes a permanent public record once filed.

Brazoria County Marriage License Records

After the ceremony, the officiant signs the license and must return it to the Brazoria County Clerk within 30 days. Texas Family Code Section 2.206 requires this. Once filed, the record is permanent and part of the public record. Certified copies can be used for name changes, insurance, Social Security updates, and other legal needs.

Certified copies from Brazoria County cost approximately $21 each. Request them in person at any clerk's office or by mail. For Texas records from 1966 onward, the Texas Department of State Health Services Vital Statistics unit offers a statewide index. They issue $20 verification letters that confirm a record exists. These are not certified copies.

Historical Brazoria County marriage records are archived at the courthouse. Genealogists can contact the clerk's office to request older documents. Some records may also be accessible through online genealogy platforms.
