How to Get Your Marriage License in Pearland

Both applicants must appear in person at a Brazoria County Clerk office. You can start the process online first. Fill in the form on the county website, then both people go to the clerk's office together to finalize it. You cannot complete the process by mail or have someone apply on your behalf (with limited exceptions for military under Texas Family Code Section 2.006).

Documents to bring for each applicant:

  • Valid government-issued photo ID such as a driver's license, state ID, or passport
  • Social Security number (know it or bring the card)
  • Certified divorce decree if either person was divorced in the last 30 days
  • Court order if either applicant is under 18 (required since September 1, 2017)
  • Twogether in Texas certificate if seeking the reduced fee and waiting period waiver

No Texas residency is required. You don't have to live in Pearland or Brazoria County to apply here. After the ceremony, the officiant signs the license and must return it to the Brazoria County Clerk within 30 days. Once the clerk records it, certified copies are available. The Texas DSHS also receives notification and adds the marriage to the statewide index.

72-Hour Waiting Period and Fees

Texas requires a 72-hour waiting period between when the clerk issues the license and when the ceremony can take place. This rule comes from Texas Family Code Section 2.204. The wait starts the moment the clerk hands you the license. If you get it Tuesday at noon, the ceremony can't happen until Friday at noon.

Exceptions apply. Active-duty military are exempt. A judge can waive the waiting period for good cause. Couples with a Twogether in Texas certificate skip the wait and also pay a reduced fee of about $22 instead of the standard $82. That's a $60 savings. The course is free, takes about eight hours, and is available both online and at sites around Texas. Visit twogetherintexas.com to learn more.

The license stays valid for 90 days. You must hold the ceremony within that window. If it expires, you apply again. Most Pearland couples apply about a week to two weeks before the wedding, which is plenty of time to clear the waiting period without risking expiration.

Marriage Records in Pearland

The Brazoria County Clerk holds all marriage records for the county. After recording, the original license becomes part of the permanent public file. Certified copies cost about $21 each. You can get them at the Angleton main office or a branch location, or by written request.

The Texas Department of State Health Services provides a $20 statewide verification letter that confirms a marriage record exists. This isn't a certified copy but works for many name-change and benefit purposes. For a certified copy, go directly to the Brazoria County Clerk.

Order a certified copy right after the wedding. Name changes, Social Security updates, and bank account changes all require it. Getting a copy while the record is fresh is easier than hunting for it months later.
