How to Get a Marriage License in Hidalgo County

Both applicants must appear together at the Hidalgo County Clerk's office in Edinburg. Residents of McAllen, Mission, Pharr, Edinburg, and all other cities in Hidalgo County get their marriage licenses at this one office. The process follows the same state rules as every other Texas county.

Each applicant must bring:

  • Valid government-issued photo ID (driver's license, state ID, passport, or military ID)
  • Social Security number (must know it; a card may help)
  • Certified divorce decree if divorced within the last 30 days
  • Court order if either applicant is under 18 (required under Texas law since September 1, 2017)

No blood test is required. No Texas residency is needed. Mexican nationals and residents of other countries may apply using valid government-issued identification. Apostille services are available for international recognition of Texas marriage certificates, which is useful for couples who plan to use their marriage certificate in Mexico or another country. The license is valid anywhere in Texas after the 72-hour wait. The application form follows the requirements in Texas Family Code Section 2.004 and asks for full legal names, maiden surnames, dates and places of birth, Social Security numbers, and prior marriage history.

If one applicant cannot appear in person, the absent applicant affidavit process under Texas Family Code Section 2.006 may be an option. Contact the clerk's office in Edinburg to ask about this before the application day.

72-Hour Waiting Period and Fees

Texas law requires a 72-hour wait from the time the license is issued before the ceremony can take place. This rule is in Texas Family Code Section 2.204. Three full days must pass from the exact time on the license. Plan the ceremony date with this in mind.

Active duty military members are exempt from the 72-hour wait. A family law judge can grant a written waiver for good cause. Couples who complete the Twogether in Texas premarital course also skip the wait and pay a lower fee. The standard fee in Hidalgo County is about $81. With a valid Twogether in Texas completion certificate, the fee drops to approximately $21. The premarital course runs 8 hours. Several course sites operate in the Rio Grande Valley area.

The license is valid for 90 days from issuance. If the ceremony does not happen within that window, the couple must reapply and pay again. Do not wait until the last few days. Apply early enough to allow a comfortable buffer before the ceremony. An informal marriage declaration (common law) is available through the Hidalgo County Clerk as well, with both applicants appearing in person.

Hidalgo County Marriage License Records
