Each applicant must bring:

  • Valid government-issued photo ID (driver's license, state ID, passport, or military ID)
  • Social Security number (know it; a card helps but may not be required)
  • Certified divorce decree if divorced within the last 30 days
  • Court order if either applicant is under 18 (required under Texas law since September 1, 2017)

No blood test is needed. No Texas residency is required. A license from Hardeman County is valid anywhere in Texas. The application asks for full legal names including maiden surnames, dates of birth, birthplaces, Social Security numbers, and any prior marriages. The form follows the rules in Texas Family Code Section 2.004.

72-Hour Waiting Period and Fees

Once the license is issued, Texas law requires a 72-hour wait before the ceremony can happen. This is set by Texas Family Code Section 2.204. Three full days must pass from the exact time the license is issued before the ceremony is legal.

Active duty military members are exempt from the wait. A judge with family law jurisdiction can grant a written waiver for good cause. Completing the Twogether in Texas premarital program also waives the 72-hour requirement and reduces the fee from about $82 to roughly $22. The course runs 8 hours. Present the certificate when applying at the clerk's office.

The license expires 90 days after it is issued. If the ceremony has not happened by then, you must reapply. An informal (common law) marriage declaration is also available through the Hardeman County Clerk for approximately $42.
