How to Get a Marriage License in Hale County

The application process in Hale County is the same as any other Texas county. Both people show up together at the clerk's office, present their IDs, complete the form, pay the fee, and then wait 72 hours before the ceremony.

What to bring:

  • Valid government-issued photo ID (driver's license, state ID, passport, or military ID)
  • Social Security number (know it; a card may be helpful)
  • Certified divorce decree if divorced within the last 30 days
  • Court order if either applicant is under 18 (required under Texas law since September 1, 2017)

No blood test is required. No Texas residency is needed. A license from Hale County is valid for use anywhere in Texas. The application form asks for full legal names, maiden surnames, dates and places of birth, Social Security numbers, and prior marriage history. This is the standard state form from Texas Family Code Section 2.004.

72-Hour Waiting Period and Fees

Texas law requires a 72-hour wait after the license is issued before the ceremony can be held. This comes from Texas Family Code Section 2.204. Count three full days from the exact time the license was issued and then you are clear to hold the ceremony.

The waiting period can be waived for active duty military members, for couples with a written judicial waiver, or for couples who complete the Twogether in Texas premarital education program. That program also reduces the fee from roughly $82 to about $22. The course is 8 hours and offered at various locations. Bring the certificate to the clerk's office when you apply.

The license expires after 90 days. If you have not held the ceremony by then, you must reapply and pay again. The informal marriage declaration (common law) is also available through the Hale County Clerk for approximately $42.

Hale County Marriage License Records

After the ceremony, the officiant signs the license and must return it to the Hale County Clerk within 30 days. Texas Family Code Section 2.206 sets this deadline. Once recorded, the license becomes part of the official public record and certified copies can be ordered.

Certified copies from the Hale County Clerk cost approximately $21 each. You can request them in person or by mail. The Texas Department of State Health Services Vital Statistics unit maintains a statewide index from 1966 forward and provides $20 verification letters confirming a record exists. These are not certified copies but serve as proof of the record for many purposes.
