How to Get a Marriage License in Brown County

Both applicants must go to the clerk's office together in Brownwood. Bring IDs, know your Social Security numbers, fill out the state form, and pay the fee. The clerk processes everything the same day in most cases.

Each applicant needs:

  • Valid government-issued photo ID (driver's license, state ID, passport, or military ID)
  • Social Security number (you must know it; a card helps but is not always required)
  • Certified copy of divorce decree if divorced within the last 30 days
  • Court order if either applicant is under 18 (required since September 1, 2017)

Residency is not required. The license is valid anywhere in Texas. No blood test or medical document is needed under current Texas law. The standard application under Texas Family Code Section 2.004 collects full legal names, dates and places of birth, Social Security numbers, and prior marriage history. Be ready to answer all questions truthfully and completely. Both applicants sign the form under oath before the clerk.

The 72-Hour Waiting Period and Fees

After the Brown County Clerk issues the license, Texas requires a 72-hour wait before the ceremony can be held. Texas Family Code Section 2.204 requires this. A license issued Wednesday morning means the earliest ceremony is Saturday morning.

Three exceptions allow the wait to be waived. Active duty military are exempt. A judge can issue a written waiver for cause. Couples who complete the Twogether in Texas premarital course skip the 72-hour hold and also pay less. That course is 8 hours long and available in various formats. Bring the completion certificate to the clerk's office when you apply. The standard Brown County fee is about $82. With the certificate, the fee drops to around $22.

The license is valid for 90 days. If you do not use it in that period, it expires and you must reapply and pay again. Plan to apply one to two weeks before the ceremony. That leaves time after the 72-hour hold while keeping you safely inside the 90-day window. Most couples find this timing works well for wedding planning purposes too.

Informal marriage declarations are also available through the Brown County Clerk's office. Both people must be present. The fee is around $42. Once filed, the declaration is a permanent public record.
