How to Get a Marriage License in Brazos County
Both applicants must go to the clerk's office in Bryan together. There is no option to apply remotely or send a representative. Fill out the state application form, show valid IDs, give your Social Security numbers, and pay the fee. The license is issued the same day in most cases.
Each applicant needs:
- Valid government-issued photo ID (driver's license, state ID, passport, or military ID)
- Social Security number (you must know it; a card is helpful)
- Certified copy of divorce decree if divorced within the last 30 days
- Court order if either applicant is under 18 (required since September 1, 2017)
No Texas or Brazos County residency is required to apply here. The license works anywhere in Texas once issued. No blood test or medical documents are required under Texas law. The application under Texas Family Code Section 2.004 asks for full legal names, birth dates, birthplaces, Social Security numbers, and information about prior marriages. Answer all questions completely and honestly. Both applicants sign the form under oath before the clerk.
College Station residents apply at the same Bryan courthouse location. There is no separate clerk's office in College Station for marriage licenses. The drive from College Station to Bryan is short, and the office is easy to access from Texas Avenue or University Drive.
The 72-Hour Waiting Period and Fees
Texas requires a 72-hour wait between the time the clerk issues the license and when the ceremony can legally be held. Texas Family Code Section 2.204 sets this rule. If you get your license Wednesday afternoon, the earliest your ceremony can happen is Saturday afternoon.
Three exceptions waive the 72-hour requirement. Active duty military are exempt. A judge can grant a written waiver for good cause. Couples who complete the Twogether in Texas premarital education course skip the wait entirely and also pay a reduced fee. The course runs 8 hours. The standard Brazos County fee is about $82, dropping to around $22 with a valid Twogether in Texas completion certificate. Present the certificate at the clerk's office when applying. Find approved course providers on the Twogether in Texas program website.
The license is valid for 90 days. If you do not hold the ceremony in that time, it expires and you must reapply and pay again. Most couples apply one to two weeks before the ceremony. This leaves plenty of time after the 72-hour wait while staying well inside the 90-day window. Given the busy nature of the Brazos County office, especially around spring graduation season at Texas A&M, it is smart to go on a weekday morning.
Brazos County also handles informal marriage declarations through the clerk's office. Both people must be present. The fee is approximately $42. The declaration is filed and becomes a permanent public record once processed.
Brazos County Marriage License Records
After the ceremony, the officiant signs the marriage license and must return it to the Brazos County Clerk within 30 days. Texas Family Code Section 2.206 requires this step. Once filed, the record is permanent and part of the public record. Certified copies can be requested for name changes, insurance, immigration, and other legal uses.
Certified copies from Brazos County cost approximately $21 each. You can get them in person at the Bryan office or by mailing a written request. For Texas records from 1966 onward, the Texas Department of State Health Services Vital Statistics unit has a statewide index and issues verification letters for $20. These confirm a record exists but are not certified copies from the county.
Historical Brazos County marriage records are held at the courthouse. Genealogists and researchers can request access through the clerk's office. Some older records may also be available through genealogy databases and archives.
