How to Get a Marriage License in Borden County

Both applicants must go to the clerk's office together. This is a requirement under Texas law. You cannot send a representative. Bring your IDs, know your Social Security numbers, fill out the state application form, and pay the fee. The process is usually quick in a small county like this.

Each applicant must provide:

  • Valid government-issued photo ID (driver's license, state ID, passport, or military ID)
  • Social Security number (you must know it; bringing the card helps)
  • Certified copy of divorce decree if divorced within the last 30 days
  • Court order if either applicant is under 18 (required since September 1, 2017)

You do not need to live in Borden County or Texas to apply here. The license is valid anywhere in Texas once issued. No blood test or health documents are required under Texas law. The state application form set by Texas Family Code Section 2.004 collects full legal names, birth information, Social Security numbers, and prior marriage history. Be ready to state whether either person has been married before and how those marriages ended.

The 72-Hour Waiting Period and Fees

After the Borden County Clerk issues the license, Texas law requires a 72-hour wait before the ceremony can take place. This rule is in Texas Family Code Section 2.204. If you get the license Thursday afternoon, the earliest legal ceremony is Sunday afternoon.

There are three ways to waive the 72-hour wait. Active duty military are exempt. A judge can issue a written waiver for cause. Couples who finish the Twogether in Texas premarital course skip the wait entirely and also pay a reduced fee. That course is 8 hours. The standard Borden County fee is roughly $82. With a valid Twogether in Texas certificate, it drops to about $22. Present the certificate at the clerk's office on the day you apply. The program website lists approved course providers statewide.

The license is valid for 90 days from issue. After 90 days it expires and you must start over. Plan your application date so the ceremony happens well before the 90-day limit. Apply one to two weeks before the ceremony in most cases.

The Borden County Clerk also handles informal (common law) marriage declarations. Both people must appear. The fee is typically around $42. Once filed, the declaration is a permanent public record.

Borden County Marriage License Records

After the ceremony, the officiant signs the license and must return it to the Borden County Clerk within 30 days as required by Texas Family Code Section 2.206. Once filed, the record is permanent and part of the public record. You can then get certified copies for name changes, legal filings, and other official purposes.

Certified copies from Borden County cost approximately $21 each. You can request them in person or by mail. For Texas marriage records from 1966 onward, the Texas Department of State Health Services Vital Statistics unit has a statewide index. Their verification letters cost $20 and confirm a record exists but are not certified copies from the county clerk.

Older Borden County marriage records are held at the courthouse. Genealogists can contact the clerk's office to request historical records. Some may also appear in digital genealogy platforms.
